• Rental Agreement for Vacation Accommodations & General Terms and Conditions (GTC)

• For the rental property: All in Rhein-Main, Premium Retreat Apartment in Ginsheim-Gustavsburg

• § 1 Contracting Parties, Scope & House Rules

• (1) This agreement governs the temporary provision of the vacation apartment for residential use between the owner/host (hereinafter referred to as the "Landlord") and the booking guest (hereinafter referred to as the "Tenant").

• (2) Validity without signature: This Rental Agreement becomes legally binding without a handwritten signature. It becomes legally binding as soon as the Tenant completes the booking process (via an online platform or by direct confirmation) and the Landlord confirms the booking.

• (3) House rules as part of the contract: By completing the booking, the Tenant expressly and fully acknowledges this rental contract and the house rules of the building in the currently valid version as a binding part of the contract. The house rules are displayed in the rental property and regulate the detailed rules of use and conduct (in particular for the spa, pool, whirlpool, sauna and gym areas). In the event of contradictions or additions, the provisions of the house rules shall apply continuously and in addition to this contract.

• § 2 Rental property & scope of use

• (1) The separate apartment, as well as the associated terrace area and the parking space, are provided to the renter exclusively for holiday use for the booked period.

• (2) The apartment has separate access via the terrace using the ABUS app. The tenant undertakes to install the app before arrival.

• (3) Subletting or transferring the property to persons not listed in the booking is strictly prohibited.

• § 3 Arrival and departure (check-in / check-out)

• (1) The rental property is available on the day of arrival from 3:00 pm (or by individual arrangement).

• (2) On the day of departure, the apartment must be vacated by 10:00 am. The tenant undertakes to comply with the following check-out points before leaving:

• Damage: All damage or defects caused during the stay must be reported to the landlord before departure.

• Linens & garbage: Used towels and bathrobes must be collected and placed in the shower. The trash must be disposed of separately in the trash cans at the terrace entrance.

• Kitchen & BBQ: The kitchen and all electrical appliances used must be left thoroughly cleaned. If the provided gas grill was used, it must also be handed over cleaned. In the event of non-compliance, the following special cleaning fees will be due:

• Uncleaned electrical appliances (oven, coffee maker, etc.): € 50

• Uncleaned dishes/kitchen utensils: €25

• Uncleaned gas grill: € 50

• Locking: The apartment must be left swept clean, the lights must be turned off, the refrigerator must be emptied, and the door must be securely locked via the ABUS app when leaving.

• § 4 Spa & gym use (free bonus)

• (1) The landlord provides the tenant with access to the large outdoor pool, the sauna and the training room (gym) as a voluntary, free bonus.

• (2) Hours of use: These areas may be used on weekdays (Monday - Thursday) from 4 pm to 9 pm and on weekends (Friday & Saturday) from 4 pm to 10 pm.

• (3) Hygiene rules: A thorough shower is mandatory before using the pool and sauna. Glass is strictly prohibited in the entire spa and pool area. A sufficiently large towel must always be placed on the sauna benches and gym equipment.

• (4) Exclusion: If the spa facilities are temporarily unusable for technical, hygienic, or adverse reasons, there is no entitlement to a rent reduction or financial reimbursement.

• § 5 Additional services on site subject to a fee (bookable extras)

• All extras used on site are settled on the day of departure in a straightforward manner by cash payment (using the envelope provided on the kitchen table) or by arrangement:

• (1) Whirlpool package (2-hour session):

• Summer season (May - September): € 50 (including exclusive use of the large outdoor pool).

• Winter season (October-April): € 35 (large outdoor pool closed).

• Condition: Registration must be made at least 2 hours in advance. For safety and hygiene reasons, only the landlord may start up the hot tub. In the event of improper soiling (e.g., from oils, food) that requires a water change, a cleaning fee of €150 will be charged.

• (2) Textile rental: Beach towels, sauna towels or bathrobes can be rented, subject to availability, for €10,- each per person per stay.

• (3) Mini market & drugstore: The goods provided in the kitchen cupboard and bathroom are marked with prices. Items taken, as well as any use of coffee and tea, must be honestly entered in the minimarket list.

• (4) Laundry service: €5,- per load (including detergent) will be charged for the use of the washer and dryer.

• (5) Personal training: Sessions with a professional, certified personal trainer & medical trainer can be booked from €50,- per 50 minutes by prior appointment.

• § 6 Events, commercial use & photo shootings

• (1) The rental property is intended exclusively for private recreation. Parties, gatherings, coaching sessions or events of any kind are only permitted in the outside area (terrace/garden) with prior agreement and approval. The interior of the apartment may not be used for this purpose.

• (2) For approved events in the outdoor area, a flat rate of € 50 per external guest and a cleaning fee of at least € 150 apply. Any overnight stays by external guests are not included and must be booked and paid for separately.

• (3) Pure location rental: For events and commercial use, the landlord only provides the location (outdoor area). All the necessary equipment, event technology, decoration and the complete furnishing (seating, tables, etc.) must be brought and organized by the renter. The apartment's inventory and furniture may not be moved outside or used for the event.

• (4) Professional photo shoots, video shoots or commercial content productions are also only permitted in the outdoor area, require registration and are charged separately at €500 to €1,500 per day, depending on the scope.

• (5) Unregistered events, breaches of the indoor ban or unauthorized commercial use will result in immediate expulsion without a refund of the rental price.

• § 7 Honesty, damage & theft

• (1) Missing textiles upon departure will be billed to the renter as follows: bathrobe € 60, large sauna towel € 35, normal towel € 15.

• (2) The free removal of goods from the mini-market as well as the removal of inventory is considered theft, subsequently charged and reported to the booking platform.

• (3) For gross soiling or disregard of the spa rules that require unscheduled special cleaning of the apartment or the wellness area (e.g., soiled sauna wood, vomit, gross stains), a lump sum of at least €150 will be charged.

• § 8 Disclaimer & Legal

• (1) The use of the rental property (including outdoor facilities, pool, hot tub, gym, sauna and all other areas) as well as all facilities located therein is carried out by the renter and their relatives, accompanying persons and visitors exclusively at their own peril, at their own risk and under their own liability.

• (2) The landlord assumes no liability for damage, theft, loss or accidents suffered by the tenant or third parties in connection with the use. The lessor's liability is limited to intent and gross negligence.

• (3) The above limitation of liability does not apply to damages resulting from injury to life, limb or health that are based on a negligent or intentional breach of duty by the landlord or one of his vicarious agents.

• (4) The renter hereby indemnifies the landlord against all liability claims asserted against the landlord by third parties (in particular by visitors or guests of the renter) in connection with the use of the rental property, unless the landlord caused the damage intentionally or through gross negligence.

• § 9 Final provisions & severability clause

• (1) Amendments and additions to this agreement must be made in writing.

• (2) Should individual provisions of this agreement be invalid or unenforceable or become invalid or unenforceable after the conclusion of the agreement, the validity of the remainder of the agreement shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective.
